Complaint Repair received the following consumer message on April 29, 2002:

Cingular Wireless - unable to pay bill, sent to collection agency, need help

I contracted for a cell phone with cingular wireless. Afterwards a series of things happened so that I was financially unable to pay the monthly payments. This left me with a debt of $384.14. which I could not pay. Cingular refered me to a collection agency, GC Services Limited Partnership Collection Agency Division 6330 Gulfton, Houston TX 77081.

This agency has sent letters and phonecalls stating that I must make arraingements with them for payment. I have called them and told them the truth, I can not at this time make montly payments larger then $10 (which I have been paying). I spoke to one of their agents today and he said that they "could not make payment arraingements of this size."

When trying to discuss the matter with him he hung up after saying that he was reporting me as refusing to make payment which I was not. The first I know is a misrepresentation, and the second I believe to be illegal. I called back and spoke to Mr. Eric Gate a supervisor trying to speak to someone more reasonable. He repeated their refusal to negociate and said that Cingular Wireless had already reported me to the credit beaures.

I then asked him if that was the case then what else could GC do to me beside send me statements as long as I was making payments. He said they had several options. I asked him what they were. He refused to tell me. Also, my original bill from them was $383.14 I am now getting bills for over $400 while makeing payments. I do not have a contract with GC in which they have a right to charge me penalties and interest.
